# Waste Duty of Care: What Paperwork Your Business Must Keep

Waste duty of care is the part of running a business that nobody thinks about until an inspector asks a question. It is not complicated, but it is a legal obligation with real penalties, and the paperwork is the bit that trips most businesses up.

**Every business is legally responsible for the waste it produces, from the moment it is created until it is properly disposed of. In practice that means using a registered waste carrier, keeping a waste transfer note or equivalent record for every collection, describing the waste accurately, and storing it so it cannot escape.**

Here is what that means day to day, and what you should be able to produce if you are asked.

## What is waste duty of care?

Duty of care makes you responsible for your waste even after it has left your premises. You cannot discharge that responsibility simply by handing it to someone else — you have to take reasonable steps to make sure the person taking it is authorised to do so and that it will end up somewhere legitimate.

This is why fly-tipping cases sometimes come back to the business that produced the waste rather than only the person who dumped it. If you paid someone with no licence and kept no record, you have not met your duty.

## What paperwork do you need?

There are four things you should be able to lay your hands on:

| Document | What it does |
| --- | --- |
| Waste transfer note | Records each transfer of waste: what it was, how much, when, from whom and to whom. A season ticket can cover repeat collections of the same waste over a period. |
| Carrier registration details | Evidence that the company collecting your waste is a registered waste carrier, which you can verify with the relevant environmental regulator. |
| Consignment note (hazardous waste) | Required instead of a transfer note where the waste is hazardous, with stricter rules and longer record keeping. |
| Waste description and codes | An accurate description of the waste, including the appropriate classification code, so that whoever receives it can handle it correctly. |

Keep these for the period required for the waste type — longer for hazardous waste than for general commercial waste — and keep them somewhere you can actually find them, not in a drawer at a site you no longer occupy.

## How to check your waste carrier is legitimate

Ask for their waste carrier registration number and check it against the public register held by the environmental regulator for your part of the UK. It takes a couple of minutes and it is the single most effective thing you can do to protect yourself.

Be wary of anyone who quotes a cash price, will not put anything in writing, cannot give you a registration number, or offers to take waste in an unmarked van. A price well below the market rate usually means the waste is not going anywhere legitimate, and the liability lands with you.

## What happens if you get it wrong?

Breaching duty of care can lead to a fixed penalty or prosecution, with fines that scale with the seriousness of the offence. Beyond the financial penalty there is the cost of clearing up waste that has been dumped, and the reputational damage of being named in an enforcement notice.

The more common and more mundane risk is simply not being able to produce records when asked, which is entirely avoidable and usually just a filing problem.

## A practical checklist

1. **Verify your carrier.** Get the registration number and check it on the public register.
2. **Get a transfer note for every collection.** Or a season ticket covering regular collections of the same waste.
3. **Describe the waste accurately.** Vague descriptions such as "general rubbish" are not adequate.
4. **Store waste securely.** Lidded, contained, and where it cannot blow away or leak.
5. **Separate what must be separated.** Compliance and cost tend to pull in the same direction here.
6. **File the records.** Digitally is fine, and easier to produce on request.
7. **Review annually.** Carrier registrations expire and contracts change.

Because the rules differ between England, Scotland, Wales and Northern Ireland, and because record-keeping periods and classification detail get updated from time to time, always check the current official guidance from the relevant environmental regulator for your nation before relying on any summary, including this one.

## Frequently asked questions about waste duty of care

### What is a waste transfer note?

It is the record of a transfer of waste from your business to a waste carrier, setting out what the waste was, how much there was, when it was collected and who the parties were. A season ticket can cover repeated collections of the same type of waste over a period rather than requiring one note per collection.

### How long must I keep waste transfer notes?

Record-keeping periods are set by regulation and are longer for hazardous waste than for ordinary commercial waste, so check the current requirement with your national environmental regulator. As a matter of practice, keeping them for longer than the minimum costs nothing and removes the risk.

### How do I check if a waste carrier is registered?

Ask for their waste carrier registration number and look it up on the public register maintained by the environmental regulator for your part of the UK. If they cannot provide a number, do not use them.

### Am I liable if my waste is fly-tipped by someone else?

You can be. Duty of care requires you to take reasonable steps to check that whoever takes your waste is authorised and that it will be handled properly, so if you used an unregistered carrier and kept no records, liability can come back to you as the producer.
